Krista Kochosky, who leads the Real Estate Practice at The Lynch Law Group, will join a panel of experienced commercial litigators to present the Pennsylvania Bar Institute Course, The Role of Indemnity and Insurance in Business Transactions and Litigation 2022. The course will be delivered via simulcast and remote webcast on May 19, 2022.

Course Overview

Indemnity clauses appear in nearly every contract. When properly drafted, these clauses can limit or shift the parties’ risk with respect to a contract, activity, or commercial venture. But too often, these clauses are either poorly drafted or cut and pasted from prior contracts and rendered meaningless and unenforceable. In addition, once an indemnity claim arises, a whole host of factors must be taken into consideration to enforce the clause or litigate the matter successfully.

This course will teach you how to draft and enforce indemnity clauses and ensure you best protect your client’s interests during disputes. The program’s panel of experts in the field will help you with:

Identifying the sources and scope of indemnity
Drafting contracts to either maximize or minimize indemnification
Demystifying the language of insurance coverage indemnity
Understanding the issues that arise during litigation

Krista Kochosky has civil litigation and transactional experience in all areas of real property law. She counsels commercial/residential property owners in sales contracts, leases (retail and OGM), and civil disputes. She assists real estate investment groups with business formation, membership interest purchase agreements, and land contracts, and assists developers and landowners with zoning and land use issues.
